Crime & Corruption

A robust and independent judiciary is fundamental to democracy, ensuring impartiality and upholding the rule of law. The ACT prioritises judicial independence to maintain checks and balances within the state.

1. Review Mechanisms for Judicial Performance and Integrity:

The ACT will advocate for a Commission of Inquiry to address allegations of judicial corruption, preserving integrity and accountability.

2. Access to Justice and Africanisation of Laws:

We propose legislation to Africanise laws, reflecting African values and legal systems for enhanced legitimacy and representation.

3. Transformation of Legal Practitioner Briefing Patterns and Diversity:

Prioritise African and female legal practitioners in state briefing patterns to foster diversity, skill development, and representation.

4. Role of Constitutional Court and Judicial Appointments:

Facilitate discussions on the finality of Constitutional Court decisions and the role of Parliament in exceptional cases, ensuring democratic oversight.

5. Enhancing Judicial Excellence and Independence:

Promote diversity in appointments to the Constitutional Court, emphasising meritocracy, expertise, and independence.
